Peerlyft – Mentee Terms and Conditions

These Terms and Conditions (“Terms”) govern your participation as a mentee (“Mentee”, “You”, “Your”) on the Peerlyft platform (“Platform”, “We”, “Us”, “Our”). By purchasing or scheduling a consulting session through the Platform, You agree to be bound by the following terms:

1. Session Entitlement

1.1. Each purchase entitles You to a one-hour (60-minute) one-on-one session with Your selected consultant (“Consultant”) and a seven (7) day post-session chat window limited strictly to clarifications regarding topics discussed during the session.

1.2. The chat window will automatically expire seven (7) days after the scheduled session time, irrespective of whether You or the Consultant initiate the chat.

2. Session Conduct

2.1. It is mandatory for the Mentee to have their video turned on at all times during the session with the face clearly visible

2.2. You must attend the session personally; the attendance or participation of any third party, including sharing access credentials, is strictly prohibited.

2.3. In the event of any such unauthorized participation, the Consultant reserves the right to terminate the session immediately, and the full fee will be forfeited without refund.

2.4. Discussions must remain within the scope of the agreed agenda. Discussing on any deviations from the defined agenda are subject to the Consultant’s sole discretion.

3. Session Timing, Rescheduling and Cancellations

3.1. The Mentee may request a reschedule once per session, provided the request is made at least 24 hours in advance of the scheduled time. Accepting additional rescheduling requests shall be at the Consultant’s sole discretion.

3.2. The Consultant is also permitted one reschedule. Any further rescheduling shall be subject to the Mentee’s consent.

3.3. If the Mentee fails to attend the session or terminates it early, no refund (full or partial) shall be applicable.

3.4. Sessions may be terminated early at the Mentee’s discretion; however, such early termination shall not entitle the Mentee to any refund.

4. Refunds and Cancellations

4.1. All payments made are non-refundable except under the following circumstances, and provided the session has not been completed:

• A scheduling or availability mismatch occurs between the Mentee and the Consultant, and no mutually acceptable time could be agreed upon.
• The Consultant fails to attend the session and is unable to reschedule at a mutually agreeable time.
• The Consultant reschedules more than once.
• The Consultant cancels the session indefinitely (excluding rescheduling attempts).
• The Consultant proposes rescheduling but You are unable to align with the new proposed time.
• The Consultant’s credentials or profile information materially differ from those displayed on the Platform.
• Any other exceptional circumstance, at the sole discretion of Peerlyft, after review on a case-by-case basis.

4.2. Refunds, if approved, will be processed within 10–15 business days from the date of confirmation.

5. Recording and Privacy

5.1. Recording or reproducing any part of the session or chat in any form (audio, video, or text) without the Consultant’s prior explicit written consent on mail is strictly prohibited.

5.2. Violation of this clause shall result in immediate termination of the session, blacklisting of Your account, and forfeiture of payments.

5.3. Peerlyft reserves the right to pursue legal remedies for any unauthorized recording, distribution, or commercial use of such material.

6. Conduct and No-Tolerance Policy

The following actions constitute a breach of these Terms and will result in permanent blacklisting of Your account and forfeiture of all payments:

• Impersonating any other person or misrepresenting Your identity.
• Failing to attend or dishonouring a confirmed session without prior notice.
• Using abusive, derogatory, or disrespectful language towards the Consultant.
• Soliciting, encouraging, or engaging in off-platform consultations or payments with any Consultant.

7. Communication and Grievances

7.1. All grievances, complaints, or refund requests must be reported in writing to complaints@peerlyft.com within 48 hours of the issue arising.

7.2. Peerlyft will assess each matter in good faith and its decision shall be final and binding.

8. Limitation of Liability

8.1. Peerlyft acts solely as an intermediary connecting Mentees and Consultants and does not guarantee the accuracy, completeness, or outcomes of any advice or guidance provided.

8.2. Under no circumstances shall Peerlyft, its affiliates, or employees be liable for any indirect, incidental, or consequential damages arising out of Your use of the Platform or interaction with Consultants.

9. Miscellaneous

9.1. Peerlyft reserves the right to modify, amend, or update these Terms at any time without prior notice.

9.2. Continued use of the Platform following such changes constitutes Your acceptance of the revised Terms.

9.3. These Terms shall be governed by and construed in accordance with the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts in Gurugram, India.

• Technical Data: Automatically collected data includes IP address, browser type, operating system, device identifiers, geolocation (approximate), and usage data (e.g., pages visited, time spent, clicks) to analyze platform performance.
• Communication Data: Records of your interactions with us, such as emails, support tickets, or chat logs with consultants/mentees, to ensure quality service.
• Voluntary Data: Information you share in surveys, reviews, or testimonials (with consent) to improve our platform or promote services.

We collect only the data necessary for our services and clearly indicate mandatory versus optional fields during sign-up.

2. How We Use Your Information

We use your information to provide, maintain, and improve our consulting platform:

• Service Delivery: Match mentees with consultants, schedule one-on-one sessions, enable chat support, and personalize your experience based on your goals (e.g., college prep, study abroad, career guidance).
• Platform Improvement: Analyze usage patterns and feedback to enhance functionality, user interface, and service offerings.
• Communication: Send transactional emails (e.g., session confirmations, payment receipts) and, with your consent, promotional emails about new consultants, features, or offers. You can unsubscribe from marketing emails at any time.
• Compliance and Safety: Verify identities, prevent fraud, enforce our Terms of Service, and comply with legal obligations in India and other regions we serve.
• Analytics: Use anonymized data to generate insights (e.g., popular consultancy categories) for internal reporting or service optimization.

We do not use your data for purposes beyond those stated unless we obtain your explicit consent.

3. How We Share Your Information

We share your information only when necessary and with appropriate safeguards:

• With Consultants/Mentees: Limited profile data (e.g., name, goals, expertise) is shared to facilitate connections. Consultants and mentees can view only the information needed for sessions or chats.
• With Service Providers: We engage trusted third parties (e.g., payment processors, cloud storage providers, analytics tools) to support our operations. These providers are bound by confidentiality agreements and process data only on our behalf.
• For Legal Purposes: We may disclose data to comply with applicable laws, court orders, or government requests in India or other jurisdictions (e.g., GDPR for EU users, CCPA for California residents). We may also share data to protect Peerlyft?s rights, safety, or property.
• Business Transfers: In the event of a merger, acquisition, or sale of assets, your data may be transferred to the new entity, with continued protection under this policy.

We do not sell or rent your personal information to third parties for marketing purposes.
